Data controller
- The data provided shall be processed by "!company_title."
Purpose
- Personal data will be processed in order to process your application for employment or other open processes and, where appropriate, to enable you to apply for a job with !company_title or other companies in the same group as defined by commercial law.
Duration
- The data processed for this purpose will be kept for the duration of the selection process and after the end of the same, we will keep it for 48 months if you give us your consent to do so in order to be able to contact you in other selection processes.
Lawful basis
- The legal basis for the processing is the implementation of pre-contractual measures at the request of the candidate or, in case of unsuccessful candidates, their consent to the storage of their curriculum vitae.
Recipients
- The data may be transferred to the following third-party recipients: Public administrations in order to comply with legal obligations. They may also be transferred to the following categories of processors: Electronic communication and online office automation providers, hosting providers, SaaS (e.g. CRM/ERP) providers, managers, accountants, auditors and lawyers. Some of these processors may be located outside the European Economic Area, in which case !company_title will have adopted appropriate data protection safeguards in advance.
Rights
- You may, at any time, exercise your right to access, rectification, erasure, restriction of processing, object or data portability through the e-mail you received after applying to any job position.
- In processing operations whose legitimacy is based on consent, the User has the right to withdraw this consent at any time. The data subject shall have the right to lodge a complaint with the supervisory authority. You are informed that your failure to provide the requested data may result in an inability to complete or fulfil the subject of the contract.
Obligations of the Candidate
- The Candidate undertakes to provide true and accurate data, keep them updated and to notify !company_title of any changes.
- The Candidate is responsible for the personal data of third parties that may be included in files owned by !company_title. In this regard, the Candidate must obtain the prior explicit consent of such third parties, after having informed them of the terms and conditions of this Privacy Policy. The Candidate undertakes to hold harmless !company_title from any possible claims, fines or penalties to which it may be subject as a result of the Candidate’s noncompliance with the duty described in this paragraph.
- The Candidate is also obliged to hold harmless !company_title from any possible claims, fines or penalties to which it may be subject as a result of the Candidate’s breach of this Privacy Policy.
Genius for People S.L., con domicilio en C/ Badajoz Nº 32, 08005 Barcelona, actúa como Encargado del Tratamiento de los datos personales de las personas candidatas por cuenta de nuestros clientes (en adelante los Responsables del Tratamiento). Mainder tratará dichos datos exclusivamente bajo las instrucciones documentadas del Responsable y para la única finalidad de prestar servicios tecnológicos de gestión de procesos de selección de personal, de conformidad con lo establecido en el art. 28 del RGPD.
No se autoriza ninguna otra finalidad, cesión o comercialización de los datos sin consentimiento expreso. El tratamiento se regirá por el contrato suscrito con el Responsable, que establece las obligaciones del Encargado y las garantías para los interesados. Mainder aplica las medidas de seguridad técnicas y organizativas apropiadas para proteger los datos personales, garantizando así un nivel de seguridad adecuado al riesgo. Sus servidores están ubicados en el Espacio Económico Europeo (EEE), cumpliendo los requisitos del RGPD.
Los datos se conservarán únicamente durante el tiempo necesario para prestar los servicios contratados y cumplir con las obligaciones legales correspondientes. Los interesados podrán ejercer en todo momento sus derechos reconocidos por el RGPD (acceso, rectificación, supresión, limitación del tratamiento, oposición y portabilidad), así como los que otorga la LOPDGDD, dirigiendo sus solicitudes al Responsable del Tratamiento (empresa contratante) o a Mainder como Encargado. Asimismo, podrán presentar reclamación ante la Agencia Española de Protección de Datos (AEPD) si lo consideran oportuno.
